Welcome to the Certified Developers website (“Site”). certified developers LLC (“certified”, “we”, “us”, and/or “our”) operates this Site to provide our users (“you” and “your”) with information about certified developers and its platform.

Certified Developers is used by professional freelancers (“Freelancers”) who want to offer development, engineering, and other services (“Services”), as well as clients who require the Services (“Clients”). Freelancers who have passed our screening process and have been accepted into our professional Freelancer network (“Network”) are referred to as “Talent.” For the purposes of this policy, the term “Freelancers” refers to both Talent and Freelancers who are not Talent. Because the Personal Data we receive from Freelancers and Clients differs, we explain our data practices for Freelancers and Clients separately below. Scope

This Privacy Policy explains how Certified Developers collects, retains, and uses information, including personal data (“Personal Data”), about Freelancers, Clients, other Site visitors and individuals, such as our vendors, partners, blog readers, and job applicants, as well as users of Certified Developers Website offerings like our image sharing and editing tool Collabshot. This Privacy Policy also applies to data collected in-person by Certified developers such as at business conferences and trade shows.

Freelancers

3.1. Information We Collect.

Information You Provide to Us

When you apply as a Freelancer on the Site, you are requesting admission to our Network. To admit you to the Network and match your qualifications with our client’s needs, we must conduct a screening process that assesses your language skills, personality, domain-specific knowledge, competence, and professionalism. We may also need to screen potential Freelancers for specific technical skills as required by our clients. In this context, you will be asked to provide information about yourself, such as:

  • your name
  • contact information
  • address
  • location
  • work experience
  • education
  • photo
  • government-issued identification
  • social network information
  • family information
  • billing information

Background Research

If and when we conduct vetting/background checks, our background check provider may collect additional data about you (including information about criminal convictions or offenses). If applicable, your consent to the collection of such additional data will be sought at that time, in accordance with applicable laws.

Data You Disclose

When you participate in our Site’s community of Certified Developers experts, we will collect the information you choose to share in that context.

Creating a Profile

We will use some of your Personal Data to create a profile that will be displayed within the Services; this profile is searchable and can be viewed by Clients looking for Freelancers.

Client Feedback

Once admitted to the Network and matched with a Client, we will receive information from our Clients regarding the performance of your services to that Client, as needed to maintain the Network’s standards of integrity and excellence.

We automatically collect certain information when you interact with Certified Developers via the Site or services. For more information, please see the “Site Visitors” section below.

3.2. How We Will Use the Data

A. Provide Service and Respond to Requests

Certified Developers will use the Personal Data you provide in accordance with this Privacy Policy. If you provide Personal Data for a specific reason, we will use the Personal Data in connection with that reason.

B. As Required by Certain Legitimate Interests

We use your Personal Data for the following legitimate interests

  • To send you administrative information, such as information about the Site and changes to our terms, conditions, and policies.
  • To conduct analytics on how you use the Site and our Service for internal purposes, such as providing, maintaining, benchmarking, and improving our offerings, and identifying usage trends.

  • To promote our services and highlight Freelancers (in particular, we can feature certain profiles of Freelancers to drive traffic from potential Clients).

  • To (a) comply with legal obligations and legal process, (b) respond to requests from public and government authorities, including public and government authorities outside your country of residence, (c) enforce our terms and conditions, (d) protect our operations, (e) protect our rights, privacy, safety, or property, and/or the rights, privacy, safety, or property of you or others, and/or (f) allow us to pursue available remedies or limit the damages that we may sustain.
  • If you request that we delete your data and we are required to do so, we will keep basic data to identify you and prevent further unwanted processing.

C. With your freely given and informed permission

If you participate in a video conference, the conference may be recorded and transcribed with your prior consent. Consent is entirely voluntary, and you may revoke it at any time. Your voice, image, in-meeting messages, and any other Personal Data you choose to share may be collected. In addition, video conference participants may be able to see your display name, email address, and profile picture. By using Zoom Video Communications, Inc. (“Zoom”) conference services, Zoom may collect, use, and share additional personal data about you, which will be used in accordance with Zoom’s Privacy Statement.

Clients

4.1. Data We Gather

A. Information you give us

When we receive a request to hire one of our Freelancers, we collect Personal Data from our prospective Clients. This includes the names and contact information of any prospective Client’s representatives, as well as any information pertaining to the Client’s requirements.

B. Third-Party Information

We may supplement the information we collected from you (for example, your email address) with additional information about you and your company obtained from publicly available and third-party databases or services that provide information about business people and companies (such as an individual’s name, job title, business contact information, and company information).

C. Data Collected Automatically

We automatically collect certain information when you interact with Certified Developers via the Site or services. For more information, please see the “Site Visitors” section below.

4.2. How We Make Use of the Data

A. To provide services and respond to inquiries.

Certified Developers will use the Personal Data you provide in accordance with this Privacy Policy. If you provide Personal Data for a specific reason, we may use the Personal Data in connection with that reason. For example, if you contact us via email, we will use the Personal Data you provide to respond to your inquiry or resolve your issue. In addition, if you provide Personal Data in order to gain access to the Services, we will use your Personal Data to provide you with access to such Services, maintain your account, contact you about your use of the Services and/or the Site or to notify you of important changes to the Services and/or the Site, and monitor your use of such services.

B. For Promotional Purposes

We may use your contact information to inform you about services we believe you will be interested in, upcoming events, or other promotions. If we do this, each marketing communication we send you will include instructions for “opting out” of future marketing communications. However, as a user of our services, you are unable to opt out of certain administrative communications that are reasonably necessary to the services, such as billing or service notifications. Furthermore, if you do not want to receive any future marketing communications or have your name removed from our mailing lists, please contact us as indicated below.

We will only send you marketing information by email if you consent to it when you provide us with your Personal Data, as required by applicable law . You have the right to withdraw your consent to be contacted for marketing purposes at any time by following the instructions to “opt-out” of receiving marketing communications in each marketing email we send you or by contacting us as indicated below

C. As Required by Certain Legitimate Interests

We use your Personal Data for the following legitimate interests

Job Seekers

5.1. We Gather Data

A. Application and evaluation procedure

When you apply for a job through our Site, our recruiting service provider will collect the Personal Data you include in your resume and cover letter. What you include in these documents is entirely up to you. However, you may want to include your name, contact information, employment history, and education.

If you are invited to participate in additional assessments (such as an interview) in connection with your application and you do so, we will collect additional Personal Data that you provide to us as part of that process. You may disclose information about your qualifications as well as information about your employment experience. You have the option of disclosing your salary history or salary expectations. If you fail to provide us with requested information, we may be unable to assess your suitability for a role with us, or we may be unable to make you an offer of employment. We may record your interview(s) with your prior consent in order to better evaluate your candidacy and for training purposes. Your consent is entirely voluntary, and you have the right to withdraw it at any time, including during the interview. If you withdraw your consent or do not consent, your candidacy will be unaffected.

We may collect Personal Data about you during the recruitment process in order to evaluate your application. For example, we may keep interview notes and record the opinions of those reviewing your application about your suitability for the role for which you have applied.’

We have a legitimate interest in facilitating the interview process and communicating job offers to you, making informed hiring decisions and selecting qualified candidates for roles with us, and improving our recruiting and hiring processes.

We will keep your contact information and resume in order to inform you of current and future job opportunities (unless you tell us that you do not want us to keep your information for that purpose) because it is in our legitimate interest to do so.

B. If your application is approved

If your application is approved, we will collect additional Personal Data about you in order to conduct reference and background checks, as required or permitted by applicable local law (including if applicable to you special categories of Personal Data, and your consent to the collection of such additional data will be solicited at such time, pursuant to applicable laws). We will also request copies of your relevant identification documents (such as your passport or driving license, proof of address, a copy of your work permit (if applicable), a photograph, and a copy of your signature). This information is used to comply with immigration requirements as well as to verify your identity for internal security purposes. We have a legitimate interest in collecting and using this information in order to comply with our legal obligations and to carry out your employment contract with us.

If you are hired, your Personal Data will be included in your employee record in accordance with our employee privacy policies.

Site Visitors

When you interact with Certified Developers via the Site or the Services (whether as a Freelancer, Client, job applicant, blog reader, software end user, or other visitor to our Site), we and our service providers acting on our behalf will automatically collect information about you via cookies (small text files placed on your device) and other technologies. Please see our Cookie Policy for more information on how we use cookies and other technologies.

As a visitor to our Site, our servers record information (“log data”), including information that your browser automatically sends whenever you visit the Site. This log data includes your Internet Protocol (“IP”) address (from which we determine the country you are connecting from when you visit the Site), browser type and settings, and the date and time of your request.

Where the information we collect automatically on our Site is Personal Data, we use it because it is necessary for the purposes of our legitimate interests in maintaining the safe operation of our Site as well as learning how Site visitors interact with our Site in order to improve your use of it.

End users of software

When you use the Certified Developer software Collabshot, we will collect account level data (your name, email, and password) for access, historical data storage, and software operation. If you create an account with credentials from a third-party service or sign-in service, such as your Google account, these services will authenticate your identity and give you the option to share certain Personal Data with us, such as your name and email address(es). Account level data is required to perform a contract with us in relation to your use of the software, or it is in our legitimate interest to respond to your requests and provide our services in the best way possible.

We may collect usage statistics when you use the software for analytics and to support and troubleshoot the software to provide you with a better user experience. We have a legitimate interest in collecting usage statistics in order to ensure that our software is functioning properly and to improve our services. We use service providers to help with user authentication and cloud hosting for screenshot storage and retrieval.

Certified Developers software contains online components, and cookies are required for proper operation. TopTracker is part of the Certified Developers main domain, and information about the cookies that are set when you use TopTracker can be found on the Certified Developers Cookie Policy.

Events

When you attend one of our events, such as business conferences or trade shows, we may collect Personal Data from you. We collect data that you voluntarily provide to us, such as your business card or contact information. We will use this information to establish a business relationship and in accordance with the purpose for which you provided the information.

Where applicable law requires, we will obtain your consent before or when sending you marketing information via email. You have the right to withdraw your consent to be contacted for marketing purposes at any time by following the instructions to “opt-out” of receiving marketing communication in each marketing email we send you or by contacting us as indicated below.

Your Personal Data and Other Information We Disclose

Certified Developers does not sell your personal information. This information is an important part of our relationship with you. However, there are some circumstances in which we may share your Personal Data with third parties, as detailed below:

Business Transfers

We may sell or buy businesses or assets as we grow our company. Personal Data may be transferred as part of the assets in the event of a corporate sale, merger, reorganization, dissolution, or similar event.

Agents, consultants, and other providers of services

Certified Developers, like many other businesses, occasionally hires outside companies to perform specific business-related functions. These parties include website analytics companies, digital advertising service providers, our hosting and cloud computing service providers, CRM, marketing, and sales software solution providers, billing and payment processing service providers, and background check service providers. When we hire another company to perform a function like this, we only provide them with the information they need to do their job. These parties may access, process, or store Personal Data in the course of performing their duties to us and solely to provide the services we have hired them to provide, as per our instructions.

Legal Prerequisites

Certified Developers may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to I comply with a legal obligation, (ii) protect and defend Certified Developers’ rights or property, (iii) act in an emergency to protect the personal safety of Site users or the public, or (iv) protect against legal liability.

Your Options

You are not required to provide any Personal Data in order to use the Site. Certain services may be unavailable if you do not provide any Personal Data.

Exclusions

This Privacy Policy does not apply to any Personal Data collected by Certified developers other than Personal Data collected through the Site or services. This Privacy Policy does not apply to any unsolicited information you provide to Certified Developers via this Site or any other means (without prejudice to your rights under the applicable law). This includes, but is not limited to, information posted to any public areas of the Site, such as forums (collectively, “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information is considered non-confidential, and Certified Developers are free to reproduce, use, disclose, distribute, and exploit such Unsolicited Information without limitation or attribution.

Children

Certified Developers does not knowingly collect Personal Information from children under the age of thirteen. Please do not submit any Personal Data through the Site if you are under the age of 13. We encourage parents and legal guardians to monitor their children’s Internet usage and to assist in the enforcement of our Privacy Policy by instructing their children not to provide Personal Data on this Site without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to Certified Developers via this Site, please contact us and we will make every effort to remove that information from our databases.

Security

Certified Developers take reasonable and appropriate precautions to protect the Personal Data collected through the Site or services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.
